1. Definitions
In these Terms and Conditions:
- Agreement means these Terms and Conditions together with any written service quote or job record issued by Ormolu.
- Ormolu, we, us and our refer to the watch repair and restoration bench operating at Level 8, Menara Sri Cempaka, Jalan Tun Perak, 50050 Kuala Lumpur, Malaysia.
- User and you refer to any individual who accesses this website or engages our services.
- Service means any watch repair, rate adjustment, dial restoration or institutional collection residency work carried out by Ormolu.
- Piece means any timepiece, movement, dial or component submitted to Ormolu for assessment or service.
2. Acceptance of Terms
By accessing this website or submitting an enquiry to Ormolu, you confirm that you are at least 18 years of age and have the legal capacity to enter into an agreement. Use of this website and engagement of our services constitutes acceptance of these terms.
3. Service Description
Ormolu provides watch repair and timepiece restoration services including rate adjustment and positional timing, dial restoration and hand refinishing, and workshop residency for institutional collections. Services are available to clients located in Malaysia and, at our discretion, internationally.
The bench operates Monday to Friday, 10:00–17:30, and Saturday 10:00–13:00. Service availability is subject to bench capacity and may be limited during certain periods.
4. Enquiries and Scope Agreement
An enquiry submitted through this website or via direct contact does not constitute a binding service agreement. A service agreement is formed only when both parties have agreed in writing on the scope of work and the price.
Ormolu reserves the right to decline any enquiry or piece without providing reasons. Where work is declined, no charge is made for the initial assessment or correspondence.
5. Pricing and Payment
Prices shown on this website are starting figures for standard scope. The confirmed price for any job is the figure stated in the written scope document issued by Ormolu. No additional charges are applied without prior written agreement.
Payment is accepted in Malaysian Ringgit (MYR). The accepted payment methods will be specified at the time of scope agreement. Full payment is due on collection of the piece unless otherwise agreed in writing.
Institutional residency arrangements
Payment terms for institutional residency are set out in the individual arrangement agreement. Quarterly invoicing is standard unless otherwise specified.
6. Custody and Handling
Ormolu takes reasonable care of each piece while it is on the premises. Each piece is logged on arrival by serial number or other identifying information and stored in individual padded containers in a locked room.
Ormolu maintains insurance for items in our custody up to a declared value agreed at the time of intake. Owners are responsible for declaring any value above standard coverage. We recommend that owners maintain their own insurance on valuable pieces.
Ormolu is not liable for pre-existing defects, damage or conditions that were present at the time of intake and recorded in the intake document.
7. Scope Changes
If inspection during the course of work reveals conditions that require a change in scope or price, Ormolu will pause work and contact the owner. No additional work is carried out until the revised scope is agreed in writing. If the owner does not agree to the revised scope, the piece is returned in its current condition and a fee may be charged for work already completed, as specified in the original agreement.
8. Intellectual Property
All content on this website, including text, layout and photographs, is the property of Ormolu or is used with permission. You may not reproduce, distribute or use this content for commercial purposes without our written consent. A limited right to view and print content for personal, non-commercial use is granted.
9. Disclaimers
This website is provided on an "as is" basis. Ormolu makes no representation that the information on this website is current, complete or free from error. We reserve the right to update or withdraw content without notice.
Watchmaking involves inherent risk when working with aged or unusual movements. While Ormolu takes all reasonable care, we cannot guarantee specific outcomes or that a piece will achieve a particular rate accuracy after service. Outcomes described on this website are illustrative of typical results and are not promises applicable to any specific piece.
10. Limitation of Liability
To the extent permitted by Malaysian law, Ormolu's total liability for any claim arising from our services is limited to the amount paid by the client for the specific service giving rise to the claim.
We are not liable for indirect, consequential or economic loss, including loss of use of a timepiece, loss of sentimental value or any financial loss arising from the condition or performance of a piece after service.
Nothing in these terms limits liability for fraud, gross negligence or personal injury caused by our fault.
11. Indemnification
You agree to indemnify and hold Ormolu harmless from any claim, loss or damage arising from your breach of these terms, your misrepresentation of ownership or value of a piece, or your failure to disclose known defects at the time of intake.
12. Termination
Either party may terminate a service agreement before work begins without charge. If work has commenced, the client may withdraw on payment of a reasonable charge for work already carried out, as specified in the scope document. Ormolu may terminate an arrangement if the client breaches these terms.
13. Governing Law and Dispute Resolution
These terms are governed by the laws of Malaysia. Any dispute arising from these terms or from the services provided by Ormolu shall first be submitted to informal resolution by written notice. If informal resolution fails within 30 days, the dispute shall be referred to mediation under the Rules of the Asian International Arbitration Centre (AIAC) before any court proceedings are commenced.
The courts of Malaysia shall have exclusive jurisdiction over any matter not resolved by the above process.
14. General Provisions
Entire agreement: These terms and any written scope document constitute the entire agreement between the parties with respect to the subject matter.
Severability: If any provision of these terms is found to be unenforceable, the remaining provisions continue in force.
No waiver: Failure to enforce any provision does not constitute a waiver of the right to enforce it in future.
Assignment: You may not assign your rights under these terms without our written consent. We may assign our rights with notice to you.
15. Changes to These Terms
Ormolu may update these terms from time to time. The "Last updated" date at the top of this page will reflect any revision. Continued use of this website or engagement of our services after an update constitutes acceptance of the revised terms. We will note material changes on the website for 30 days following the update.
